Terms & Conditions
​Bookings
1. A mediation booking will be confirmed once I, Maurice Woolf (trading as Caldera Mediation) have received written confirmation from all parties that they wish to proceed.
2. The mediator remains free to accept other assignments until such time as the booking is confirmed by all parties.
Fees
3. The mediator’s fees will be calculated using the rate quoted by Caldera Mediation at time of booking. The fees quoted to you will be the all the fees you will be asked to pay for the mediator’s services (the Mediator Fee) other than overtime and expenses. The fees will include a charge for reading/preparation and a day's mediation (the Mediation Day) plus a follow up . The Mediation Day is 7 hours (typically 10am-5pm) , additional hours will be charged at the stipulated overtime rate. There are no additional booking or administration fees. In general, the Mediator Fee costs and expenses are shared equally between the parties.
4. A payment of the Mediator Fee on account will be required from the parties in cleared funds advance of the mediation.
5. All reasonable expenses incurred by the mediator such as travel accommodation and meals will be payable at cost.
6. The cost of the mediation venue and any catering or additional services is not included in the mediator’s fees.
Payment Terms
7. The payment on account must be made by the parties prior to the Mediation Day and no later than the date stated on the invoice. Failure to provide funds on account will lead to the mediation booking being released by the mediator and cancellation fees applied if applicable.
8. Following the mediation, the parties will be invoiced for any additional fees and/or expenses that have been incurred over and above that covered by the initial payment on account. Payment terms of 15 days shall apply.
9. The following cancellation fees apply to all postponed (by more than 30 days) and cancelled mediations:
9.1 There is no fee if the cancellation is more than 10 working days before the Mediation Day;
9.2 If the cancellation is made six to ten working days before the Mediation Day, 25% of the Mediator Fee;
9.3 If the cancellation is made three to five working days before the Mediation Day, 50% of the Mediator Fee; or
9.4 If the cancellation is made two or less working days before the Mediation Day, the full Mediator Fee;
10. Any expenses incurred by Caldera Mediation will also be payable in full regardless of the cancellation notice given by the parties.
11. All cancellation fees will be shared equally between the parties in any event.
12. These cancellation provisions are applicable without prejudice to a party’s right to recover costs from any party it may consider to be at fault for the cancellation.
Venue
13. Mediation often takes place at either party’s solicitor’s office (where neither party are precious about ‘home advantage’ and if one firm’s facilities are better suited for hosting the mediation), equally a neutral venue arranged by one of the firms or the participants (with input from Caldera Mediation). the venue will require a room for each party, a joint meeting room and a space for the Mediator.
Professional Indemnity Insurance
14. A copy of Caldera Mediation's Professional Indemnity Insurance is available upon request.

Governing Law
15. These terms are governed by English law.
